Dairy Farm Owner Fined $15,000 For Discharging Manure Into North Branch Creek West

John Hazeleger was fined $15,000 for discharging liquid manure into North Branch Creek West, which may have impaired the quality of the water, contrary to the Ontario Water Resources Act (OWRA).

Mr. Hazeleger owns and operates a dairy farm in the Township of Zorra. The ministry became aware of dead fish in Mud Creek, near Embro. Mud Creek is a tributary of the Thames River and is connected to North Branch Creek West and Embro Creek.
 

The ministry attended the farm to investigate the discharge. The ministry observed that manure was continuing to discharge in small amounts into North Branch Creek West, from the manure storage pit on the property. Mr. Hazeleger advised the ministry that he had discovered an accidental discharge from his manure storage pit. To prevent further manure migration across the flood plain and into the Creek, Mr. Hazeleger created berms in low flood plain areas, was arranging the completion of a block wall barrier, and had removed the manure from the flood plain with a hired contractor.

The company was fined $15,000 plus a victim fine surcharge of $7,500 and was given one year to pay the fine.
